Terms of Service

The short version

• These terms cover your use of this website. They do not cover the work we do for clients. That is governed by a separate written agreement.
• Sending us an inquiry does not make you a client, and it does not make what you send confidential.
• The content on the Site is ours or used with permission. Read it, learn from it, share links to it. Do not copy it.
• Case studies show what happened for specific clients. They are not a guarantee of what will happen for you.
• The Site is provided as-is, and Hawaiʻi law governs.

1. Agreement to these terms

By accessing or using thecrvl.com (the “Site”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site.

The Site is operated by TheCRVL LLC (“TheCRVL,” “we,” “us”), based in Honolulu, Hawaiʻi.

2. What the Site is

The Site describes TheCRVL’s services, shows examples of past work, and gives you a way to contact us. It is an informational and marketing site.

Our services are not provided through the Site. Any consulting, marketing, development, or other work we do for a client is governed by a separate written engagement agreement between that client and TheCRVL. That agreement, not these Terms, controls scope, fees, deliverables, timelines, ownership of work product, cancellation, and refunds. If anything in these Terms conflicts with a signed engagement agreement, the engagement agreement controls for the matters it covers.

3. Inquiries through the Site

When you submit the contact form:

No engagement is formed. Submitting an inquiry, and any reply we send, does not create a client relationship, a consulting relationship, a partnership, or any obligation on our part. An engagement exists only when both parties sign a written agreement.

No confidentiality. We are a business accelerator. People describe their businesses, ideas, and plans to us regularly, and many of those overlap with each other and with work we are already doing. Anything you send through the contact form is treated as non-confidential and non-proprietary. Do not send trade secrets, proprietary information, or anything you would want protected by a non-disclosure agreement until one is in place. If we end up working together, confidentiality will be handled in the engagement agreement.

No obligation to respond. We read what comes in, but we cannot promise a response to every inquiry or a response within any particular time.

Be accurate. Provide real contact information, and do not misrepresent who you are or who you represent.

4. Acceptable use

You may use the Site to learn about TheCRVL and to contact us. You may not:

• Use the contact form to send spam, unsolicited advertising, or abusive, threatening, or unlawful content
• Submit false or misleading information
• Use automated tools (bots, scrapers, crawlers) to access the Site or submit the form, other than standard search engine indexing
• Attempt to bypass rate limits, bot protection, or any other security measure
• Probe, scan, or test the Site for vulnerabilities without our written permission
• Interfere with the operation of the Site or the servers and networks connected to it
• Use the Site in any way that violates applicable law

We may restrict or block access to the Site for anyone who violates these Terms, at our discretion and without notice.

5. Intellectual property

Our content. The Site and its contents (text, design, graphics, logos, images, video, code, and layout) are owned by TheCRVL or used with permission, and are protected by copyright, trademark, and other laws. You may view the Site and share links to it. You may not copy, reproduce, republish, distribute, modify, or create derivative works from Site content without our written permission, except for brief quotations with attribution for the purpose of commentary or review.

Client names, logos, and work. Client names, logos, trademarks, and work shown in case studies belong to those clients and appear with their permission. Nothing on the Site grants you any right to use them.

Third-party trademarks. Other names and marks appearing on the Site belong to their respective owners. Their appearance does not imply endorsement of or by TheCRVL.

Feedback. If you send us ideas or suggestions about the Site or our services, we may use them without any obligation to you.

6. Case studies, testimonials, and results

Case studies and testimonials on the Site describe real work for real clients, published with their permission. They reflect the specific circumstances, timing, market, and effort of those engagements. They are examples, not promises.

Results vary. Nothing on the Site guarantees that you will achieve any particular outcome, revenue, growth, or result. What happened for one client is not a prediction of what will happen for another.

7. Not professional advice

Content on the Site is general information about business, marketing, and growth. It is not legal, financial, tax, accounting, or investment advice, and it is not tailored to your situation. Do not act on Site content without advice from a qualified professional who knows your circumstances. Any advice we provide to clients is delivered under an engagement agreement, not through the Site.

8. Third-party links and services

The Site may link to third-party websites, including client sites and social media. We do not control them and are not responsible for their content, policies, or practices. The Site also relies on third-party services to operate (hosting, email delivery, bot protection), and their availability is outside our control.

9. Disclaimer of warranties

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that information on it is complete or current. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, TheCRVL and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Site, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability to you for any claim arising from the Site will not exceed one hundred US dollars ($100). This section applies only to the Site. Liability under any engagement agreement is governed by that agreement.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless TheCRVL and its owners, employees, and contractors from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.

12. Governing law and disputes

These Terms are governed by the laws of the State of Hawaiʻi, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Honolulu, Hawaiʻi, and you consent to the jurisdiction of those courts.

13. Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms. When we do, we will change the effective date at the top. Continued use of the Site after a change means you accept the updated Terms.

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and TheCRVL regarding the Site. You may not assign these Terms. We may assign them in connection with a business transfer.
